Information obligation of the National Labour Inspectorate

In accordance with the valid legal regulations in the field of personal data protection (Articles 13 and 14 of the GDPR / Sections 19 and 20 of Act No. 18/2018 Coll. on the Protection of Personal Data), the controller processes personal data of natural persons (i.e., "data subjects" for the purposes of personal data protection), which it obtains either directly from them or indirectly from other entities.
In the case of direct collection of personal data, the controller is obliged to inform the data subject about the processing of their personal data at the latest during the collection itself (demonstrably, in an appropriate manner, simply, and comprehensibly).
In the second case, it proceeds according to Art. 14 or Section 20 of Act No. 18/2018 Coll.
Thus, in the performance of the controller's tasks and obligations, the controller obtains the personal data of data subjects directly from them, or obtains them from third parties (e.g., from an employer where the controller is performing an inspection, or from entities providing cooperation, etc.).
For the processing of personal data of data subjects that the controller obtained from third parties in the performance of its tasks and obligations, the exceptions according to Art. 14(5) of the GDPR or Section 20(5) of Act No. 18/2018 Coll. apply. This mainly concerns inspection activities, as well as the controller's obligations as an employer regarding family members or close persons of an employee.
The controller processes personal data of data subjects on the basis of special legal regulations; failure to provide them could result in the impossibility of performing the tasks and obligations of the office.
Personal Data Protection Principles:
- The controller has a legal obligation to provide personal data during inspections or at the request of authorized third parties (e.g., law enforcement authorities, police, courts).
- Other recipients are the data subjects themselves.
- Personal data is stored securely and only for the period necessary. Access is restricted to authorized persons following the controller's security policy.
- Storage is subject to Act No. 395/2002 Coll. on Archives and Registries and the internal Registry Plan.
- Data is backed up in accordance with retention rules to prevent security incidents. The controller ensures backup in accordance with GDPR and Act No. 18/2018 Coll.
- The controller does not publish personal data and does not transfer it to third countries/international organizations, except for transfers based on Regulation (EU) No. 1024/2012 – the IMI Regulation.
- Personal data will not be used for automated individual decision-making, including profiling.
Legal basis for the processing:
Personal data is processed based on special legal regulations and purposes specified by the controller.
Rights of data subjects:
- Right of access – the right to a copy of personal data and information on how it is used.
- Right to rectification – the controller must ensure data is accurate and up to date.
- Right to erasure (to be forgotten) – the right to request deletion if data is no longer needed, subject to legal obligations.
- Right to restriction of processing – the right to request a temporary stop to using data in certain cases.
- Right to data portability – applicable only to data obtained by consent or contract.
- Right to object – the right to object to processing based on legitimate interests.
- Right to withdraw consent – if processing is based on consent, it can be withdrawn at any time.
